Navigation data
During their normal operations, the IT systems and software procedures used to enable this website to function acquire some personal data whose transmission is implicit in the use of the internet communication protocols.
This information is not collected in order to be associated with identified subjects but, owing to the very nature of the information, the processing and association of the data with data held by third parties may enable the users to be identified.
The category of data includes IP addresses or the computer domain names used by users connecting to the website, the URI (Uniform Resource Identifier) addresses for the resources requested, the timing of the request, the method used to make the request to the server, the size of the file obtained in response, the numeric code for the status of response issued by the server – successful outcome, error, etc. and other parameters relating to the operating system and the user’s IT environment.
These data are only used for the purpose of gathering anonymous statistical information on the use of the site and to check that the site is operating correctly and the data are deleted immediately after processing. Le presenti informazioni sono rivolte a qualsiasi soggetto interessato all’acquisto dei lotti posti in vendita da Anglicana Aste s.a.s di F. Gelardini nelle proprie aste. Informazioni riguardanti l’asta in corso sono inserite anche nel catalogo sul sito dell’Anglicana Aste s.a.s. 
Il seguente regolamento riguarda esclusivamente la vendita on line sulla piattaforma www.bidinside.com          
 
L’Anglicana Aste s.a.s di F. Gelardini (d’ora in avanti AAG) agisce direttamente o quale mandataria in esclusiva in nome proprio e per conto di ciascun venditore il cui nome viene trascritto negli appositi registri di P.S. presso l’Anglicana Aste s.a.s. Gli effetti della vendita influiscono sul venditore e l’ Anglicana Aste s.a.s non assume, quando agisce quale mandataria, nei confronti dell’aggiudicatario o di terzi in genere altra responsabilità oltre quella ad essa derivante dalla propria qualità di mandataria.

Gli oggetti vengono aggiudicati al migliore offerente e per contanti. Le offerte potranno essere effettuate attraverso il nostro sito (www.anglicanaaste.it) o i portali web pubblicati nelle informazioni di vendita, via email, via fax, telefonicamente (in questo caso le telefonate saranno registrate, a discrezione della AAG) o direttamente presso la sede della AAG. Le offerte telefoniche, via fax, via email, attraverso il nostro sito o i portali web sopra indicati potranno essere effettuate sino all’ora indicata nelle informazioni dell’asta. La partecipazione all’asta in nome e per conto di terzi potrà essere accettata esclusivamente previo deposito presso gli uffici della AAG di una procura autenticata e di adeguate referenze bancarie.
La AAG ha la facoltà di ritirare dall’asta qualsiasi lotto. Il banditore, ha facoltà di variare l’ordine di vendita. Lo stesso potrà, a proprio insindacabile giudizio, ritirare i lotti qualora le offerte in asta non raggiungano il prezzo di riserva concordato tra AAG e venditore.
L’ aggiudicatario corrisponderà all AAG una commissione d’asta, pari al 24% comprensivo d’IVA, per ciascun lotto.
A tutti i partecipanti all’asta è richiesto, ai sensi della validità di un eventuale aggiudicazione, di compilare una scheda di partecipazione con i dati personali e le informazioni richieste, prima di ogni asta. Per i minorenni, ogni attività dovrà essere effettuata tramite il genitore o comunque persona esercente la potestà parentale o il tutore.
La AAG può accettare mandati per l’acquisto, effettuando rilanci mediante il banditore, in gara con il pubblico partecipante on line. Nel caso di offerte identiche per il medesimo lotto, lo stesso verrà aggiudicato all’offerente la cui offerta sia stata ricevuta per prima. La AAG si riserva il diritto di rifiutare le offerte di acquirenti non conosciuti a meno che non venga rilasciato un deposito a intera copertura del valore dei lotti desiderati o, in ogni caso, fornita altra adeguata garanzia.
La AAG quando agisce in qualità di mandataria dei venditori declina ogni responsabilità in ordine alla descrizione degli oggetti contenuta nei cataloghi, nelle brochure ed in qualsiasi altro materiale illustrativo; le descrizioni di cui sopra, così come ogni altra indicazione o illustrazione, sono puramente indicative e non potranno generare affidamento di alcun tipo negli aggiudicatari. Dopo l’aggiudicazione, né la AAG né i venditori potranno esser responsabili per i vizi relativi allo stato di conservazione, per l’errata attribuzione, per la provenienza, per il peso e per la mancanza di qualità degli oggetti. Né la AAG né il personale incaricato della AAG potranno rilasciare una qualsiasi garanzia in tal senso, salvi i casi previsti dalla legge. Ai fini e per gli effetti dell’art. 1488, comma 2, del codice civile, La AAG precisa che la presente vendita costituisce contratto aleatorio ed è esclusa, quindi, ogni garanzia per l’evizione provocata dal preesistente diritto di un terzo. inoltre La AAG si impegna a fornire all’aggiudicatario il bene che quest’ultimo si è obbligato ad acquistare, fatti salvi gli impedimenti dovuti a causa di forza maggiore, od altra causa che esuli da proprio ragionevole controllo (quale, ad esempio, scioperi, furti, incendi od altri disastri naturali, ritardi ed annullamenti di viaggi di trasporto) ovvero altre cause dovute alla volontà di terzi e non dipendenti dalla AAG (quali, ad esempio, divieti alla vendita, all’esportazione od all’importazione posti da Autorità Statali Italiane o Straniere). La AAG rifonderà le somme ricevute dall’aggiudicatario per l’acquisto del bene ad esclusione di quelle relative alle spese per il trasporto del bene, se avvenuto od in corso, per l’assicurazione dello stesso e le tasse doganali e/o di importazione.
Le stime relative al possibile prezzo di vendita di ciascun lotto sono stampate sotto la descrizione dei lotti riportata nel catalogo e non includono i diritti d’asta dovuti all’aggiudicatario. Le descrizioni dei lotti nel catalogo potranno essere soggette a revisione, mediante comunicazioni al pubblico durante durante lo svolgimento dell’asta . 
Il pagamento totale del prezzo di aggiudicazione e dei diritti d’asta dovrà essere effettuato per intero, in Euro, entro dieci giorni dalla aggiudicazione. In difetto La AAG, fatto comunque salvo il risarcimento dei maggiori danni, potrà: a) procedere per l’esecuzione coattiva dell’obbligo di acquisto; b) alienare il lotto a trattativa privata oppure in un’asta successiva in danno dell’aggiudicatario, trattenendo comunque, a titolo di penale, eventuali acconti ricevuti. La consegna del lotto aggiudicato potrà avvenire esclusivamente dal momento della verifica dell’avvenuto pagamento dello stesso.
La spedizione per il ritiro dei lotti acquistati sarà a spese e rischio dell’acquirente che volendo potrà richiedere di assicurare il bene.
 Il pagamento dei lotti aggiudicati dovrà avvenire entro e non oltre 10 giorni dall’invio della fattura di acquisto all’indirizzo email indicato dall’aggiudicatario. A partire dal 21° giorno seguente l’invio della stessa, verrà addebitata una penale dell’1%/mese sull’importo della fattura insoluta. Qualora l’aggiudicatario non dovesse effettuare il pagamento dovuto nei termini stabiliti e quindi risultare insolvente, autorizza espressamente la AAG a stornare la vendita, offrire il bene a terzi possibili acquirenti, a segnalare il proprio nominativo nelle Black List nazionali ed internazionali dei cattivi pagatori e a qualsiasi operatore o soggetto interessato ne faccia richiesta. L’aggiudicatario insolvente non potrà più partecipare ad alcuna vendita di beni della AAG.
Gli aggiudicatari sono tenuti all’osservanza di tutte le disposizioni legislative o regolamentari in vigore relativamente agli oggetti dichiarati di interesse storico o artistico particolarmente importante. L’esportazione di oggetti di rilevante interesse storico ed artistico da parte di aggiudicatari residenti e non residenti in Italia è regolata da specifiche normative doganali, valutarie e tributarie. I tempi di attesa di un permesso di libera circolazione sono di circa 90 giorni dal giorno delle richieste all’Ufficio Esportazione competente. La richiesta del permesso è inoltrata all’Ufficio Esportazione solo previo pagamento del lotto e su esplicita autorizzazione dell’aggiudicatario a cui saranno addebitate le relative spese. La AAG non assume alcuna responsabilità nei confronti degli aggiudicatari in ordine ad eventuali restrizioni all’esportazione dei lotti aggiudicati, né in ordine ad eventuali autorizzazioni o attestati che l’aggiudicatario dovrà ottenere in base alla legge italiana. L’aggiudicatario, in caso di esercizio del diritto di prelazione da parte dello Stato italiano, non potrà pretendere dalla AAG o dal venditore alcun rimborso di eventuali interessi sul prezzo e sulle commissioni d’asta già corrisposte.
Gli aggiudicatari (cittadini italiani o residenti in Italia) sono tenuti a fornire all a AAG un valido documento d’identità ed il proprio Codice Fiscale o Partita IVA
Le indicazioni e descrizioni contenute nel catalogo sono opinioni soggettive e sono espresse in buona fede.
La AAG in osservanza all’articolo 49, comma 1, del D.Lgs. n. 231/2007, non può accettare pagamenti in contanti per un importo pari o superiore ai 1.999,00 (mila novecento novanta nove/00) euro.
I lotti contenenti più oggetti non illustrati sono venduti come visti e piaciuti e non sono soggetti a resa da parte dell’acquirente.
Le presenti condizioni di vendita sono accettate automaticamente da quanti concorrono all’asta e sono a disposizione di qualsiasi interessato che ne faccia richiesta.
Ai sensi dell’art.13 del D.Lgs. n. 196 del 30.6.2003 (Codice Privacy) si informa il partecipante all’asta che i suoi dati personali saranno trattati per (I) finalità funzionali all’adempimento di obblighi fiscali, contabili e di legge e finalità di gestione contratti e clientela e (II) finalità connesse all’attività commerciale. I dati saranno trattati, anche attraverso la creazione e la gestione di un archivio centrale, con supporti cartacei, informatici e telematici a cui ha accesso personale specializzato e autorizzato. Il conferimento dei dati personali essenziali per gli adempimenti di legge e/o all’instaurazione e/o prosecuzione del rapporto contrattuale è obbligatorio, nel senso che in mancanza sarà impossibile instaurare e/o dar corso a tale rapporto. Il conferimento degli altri dati personali è facoltativo e in genere funzionale a fornire un migliore servizio alla clientela; un eventuale rifiuto a tale conferimento non avrà conseguenze negative a carico del partecipante. I dati personali che riguardano il cliente potranno essere oggetto di Comunicazione a società controllanti, controllate e/o collegate per le stesse finalità di cui sopra o a soggetti esterni di servizi specializzati in: I) gestione di software, hardware, sistemi telematici e informativi; II) attività di elaborazione e archiviazione dati ; (III) attività di stampa, trasmissione, imbustamento, trasporto e smistamento delle comunicazioni alla clientela; (IV) servizi di finanziamento, recupero crediti e rilevamento rischi finanziari. Il partecipante potrà sempre esercitare i diritti previsti dall’articolo 7 del Codice Privacy. Il Titolare del trattamento è Anglicana Aste s.a.s di F. Gelardini, con sede legale in Roma, Via Velletri 49 - 00198 Roma. Il responsabile è il signor Flaviano Gelardini. Il partecipante, con l’invio telematico della conferma del proprio ordine d’acquisto, prende atto della suesposta informativa ed acconsente al trattamento dei dati personali forniti.
Ogni controversia relativa alla applicazione, esecuzione, interpretazione e violazione del presente contratto d’acquisto è sottoposta alla giurisdizione italiana. Per qualsiasi controversia tra le parti in merito al presente contratto sarà di esclusiva competenza del Foro di Roma.
